Refugees \u201cneed to feel safe\u201d in their host country, lawyers say, and the Costa Rican state has a \u201cnon-negotiable obligation\u201d to protect them.<br\/> <\/p>\n\n<p class=\"wp-block-paragraph\">The murder of Samcam, whose case is already <a href=\"https:\/\/confidencial.digital\/en\/english\/the-first-level-of-justice-costa-rican-prosecutors-charge-samcams-killers\/\" target=\"_blank\" rel=\"noreferrer noopener\">before Costa Rican courts<\/a>, has generated widespread uncertainty among exiled Nicaraguans. They view it as the clearest example of the Nicaraguan dictatorship\u2019s transnational repression and are demanding that the trial not only convict the direct perpetrators but also establish who planned the crime. <\/p>\n\n<p class=\"wp-block-paragraph\">Identifying the intellectual authors of the murder is \u201cthe main challenge of the judicial investigation,\u201d warned Federico Campos, attorney for the Samcam family, during the <em>Persecution Without Borders forum <\/em>held in San Jos\u00e9 on the first anniversary of the Nicaraguan opposition figure\u2019s killing. However, he added, \u201cit is part of the work we are doing,\u201d and expressed hope that \u201cduring the trial, the direct perpetrators will overcome their fear and provide clues that could lead to those who masterminded the crime.\u201d <\/p>\n\n<p class=\"wp-block-paragraph\">Campos stressed that determining <a href=\"https:\/\/confidencial.digital\/nacion\/fiscalia-de-costa-rica-acusa-a-sospechosos-del-asesinato-de-roberto-samcam\/\" target=\"_blank\" rel=\"noreferrer noopener\">who planned the murder,<\/a> committed on June 19, 2025, is \u201cvery important\u201d not only for the family\u2019s peace of mind, but also so that \u201cpolitical refugees in this country can feel confident that here, in Costa Rica, they are truly safe and that the state is providing the support they require.\u201d<br\/><\/p>\n\n<h2 id=\"h-el-deber-de-proteccion-de-los-refugiados\" class=\"wp-block-heading\"><strong>The Duty to Protect Refugees<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">For former Costa Rican president Luis Guillermo Sol\u00eds (2014\u20132018), solving the Samcam case \u201cis not simply a matter of ethical or moral vindication; it also has legal implications that cannot be overlooked.\u201d He emphasized that if Costa Rica fails to safeguard the security of refugees, it risks undermining its own national security.<br\/>  <\/p>\n\n<p class=\"wp-block-paragraph\">\u201cWhen a country is unable\u2014and the Costa Rican state is unable\u2014to provide guarantees that people who have sought refuge and protection will actually receive them, it seriously compromises the security not only of that persecuted population, but of the entire nation,\u201d Sol\u00eds said.<\/p>\n\n<p class=\"wp-block-paragraph\">The former president recalled that the Costa Rican state has a \u201cnon-negotiable obligation\u201d to protect refugees\u2014\u201ca protection that goes far beyond physical, legal, or material security and involves broader structural factors.\u201d However, he argued, guaranteeing that protection requires \u201cpolitical will,\u201d something that, at present, \u201cis not sufficient.\u201d  <\/p>\n\n<h2 id=\"h-la-voluntad-politica-de-las-autoridades\" class=\"wp-block-heading\"><strong>Political Will of the Authorities<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Sol\u00eds and Campos agree that political will is \u201cessential\u201d to guaranteeing the protection of refugees and lament that the Executive Branch has sidelined the issue in recent years.<\/p>\n\n<p class=\"wp-block-paragraph\">According to Campos, \u201cunlike government authorities,\u201d Costa Rica\u2019s Judicial Investigation Agency (OIJ) and the Public Prosecutor\u2019s Office \u201chave taken Samcam\u2019s murder very seriously.\u201d \u201cSo much so that in less than a year, from the standpoint of the direct perpetrators, the case is already solved. They have been formally charged, and now we are headed to the preliminary hearing,\u201d he said.<br\/>  <\/p>\n\n<p class=\"wp-block-paragraph\">\u201cWhatever may still happen to refugees in this country, at least there remains a Judicial Branch that supports them. The best example is Roberto Samcam\u2019s case. Clearly, that is extremely important for refugees\u2019 security, their stability, and for helping them feel that the Costa Rican state\u2019s obligation toward them is being upheld,\u201d Campos added.<\/p>\n\n<p class=\"wp-block-paragraph\">Meanwhile, Sol\u00eds pointed to the need for a \u201crenewal\u201d of Costa Rica\u2019s Directorate of Intelligence and State Security (DIS). <\/p>\n\n<p class=\"wp-block-paragraph\">\u201cWe continue to have an intelligence and security apparatus that at times behaves like a political police force,\u201d the former president warned. He added that there have long been persistent reports \u201cabout the counterintelligence operations that the Nicaraguan dictatorship has embedded in Costa Rica and that have been coordinated through Nicaragua\u2019s own diplomatic representation in our country.\u201d  <\/p>\n\n<p class=\"wp-block-paragraph\">On this point, Campos said he hopes the Samcam case <a href=\"https:\/\/confidencial.digital\/en\/nation\/the-killing-of-roberto-samcam-in-costa-rica\/\" type=\"post\" id=\"174350\">\u201cwill serve to expose everything that needs to be exposed,<\/a> but also to bring about the reforms that the Costa Rican state must undertake so that political refugees truly feel protected,\u201d he concluded.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>One year after the murder of Nicaraguan political exile and retired army major Roberto Samcam in San Jos\u00e9, Costa Rica, solving the case has become a \u201csecurity necessity\u201d for the Nicaraguan exile community.
