{"id":186483,"date":"2026-04-07T12:52:27","date_gmt":"2026-04-07T18:52:27","guid":{"rendered":"https:\/\/confidencial.digital\/sin-categoria\/retired-colonel-carlos-brenes-and-his-wife-sentenced-to-15-years-in-prison\/"},"modified":"2026-04-08T02:08:35","modified_gmt":"2026-04-08T08:08:35","slug":"retired-colonel-carlos-brenes-and-his-wife-sentenced-to-15-years-in-prison","status":"publish","type":"post","link":"https:\/\/confidencial.digital\/en\/policy\/retired-colonel-carlos-brenes-and-his-wife-sentenced-to-15-years-in-prison\/","title":{"rendered":"Retired Colonel Carlos Brenes and His Wife Sentenced to 15 Years in Prison<br>"},"content":{"rendered":"\n<p>Retired army colonel Carlos Brenes S\u00e1nchez, 70, and his wife, Salvadora del Socorro Mart\u00ednez Aburto, 68, have been sentenced to 15 years in prison for the alleged crime of \u201ctreason,\u201d according to a resolution on \u201curgent measures\u201d issued by the Inter-American Court of Human Rights (IACHR).<\/p>\n\n<p>\u201cThe Presidency was informed that they were subjected to criminal proceedings for the crime of treason and that they received a sentence of 15 years,\u201d the court stated in a <a href=\"https:\/\/corteidh.or.cr\/docs\/medidas\/chamorro_se_19.pdf\">resolution<\/a> signed by its president, Rodrigo Mudrovitsch, on April 1, 2026.<br\/><\/p>\n\n<p>The regional court was informed of the conviction after receiving, on March 30, 2026, a request to expand provisional measures from the Inter-American Commission on Human Rights (IACHR).<br\/><\/p>\n\n<p>Carlos Brenes and his wife were <a href=\"https:\/\/confidencial.digital\/politica\/policia-captura-al-coronel-en-retiro-carlos-brenes-exreo-politico-de-la-dictadura-en-2018\/\">arbitrarily detained by the National Police on August 14, 2025,<\/a> and, according to the Mechanism for the Recognition of Political Prisoners, they are considered victims of \u201cenforced disappearance.\u201d<br\/><\/p>\n\n<p>According to unofficial information cited by the court, they are believed to be held at the Jorge Navarro Penitentiary System, known as \u201cLa Modelo,\u201d and the Comprehensive Women\u2019s Penitentiary Facility, known as \u201cLa Esperanza.\u201d<br\/> <\/p>\n\n<p>However, the court noted that the whereabouts of Carlos Brenes S\u00e1nchez and Salvadora Mart\u00ednez Aburto have not been reliably confirmed.<\/p>\n\n<p>\u201cNo family member or associate has had contact with them since their detention,\u201d the president of the court stated.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-primera-detencion-de-carlos-brenes\">Brenes\u2019 First Detention<\/h2>\n\n<p>Carlos Brenes S\u00e1nchez retired from the Sandinista Popular Army in 1994 with the rank of colonel. He was one of the founders and coordinator of the Patriotic Group of Retired Military Personnel and a member of the Broad Front for Democracy (FAD), which criticized the authoritarian turn of the Ortega government. <\/p>\n\n<p>Following the April 2018 protests, Brenes was first <a href=\"https:\/\/confidencial.digital\/nacion\/ortega-acusa-de-terrorismo-a-excoronel-eps\/\" target=\"_blank\" rel=\"noreferrer noopener\">detained on August 28 of that year at the Pe\u00f1as Blancas border crossing<\/a> while traveling to Costa Rica for a medical check-up related to his diabetes.<br\/><\/p>\n\n<p>Originally from Monimb\u00f3, Masaya, a participant in the 1978\u20131979 insurrection and a former military leader within the FSLN\u2019s Internal Front, Brenes was accused of \u201cterrorism\u201d by the Ortega-Murillo regime and remained imprisoned until his release on June 19, 2019, under a self-amnesty approved by the government. <\/p>\n\n<p>Brenes was held in a punishment cell at La Modelo, accused without evidence of directing alleged armed attacks against police in Carazo and Masaya. As a result of more than ten months in prison, his chronic conditions\u2014hypertension and diabetes\u2014worsened, both of which require ongoing medical care. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-corte-idh-amplia-medidas-provisionales-nbsp\">IACHR Expands Provisional Measures <\/h2>\n\n<p>The Inter-American Court of Human Rights (IACHR) has expanded provisional measures in favor of five prisoners held by the dictatorship. In addition to Carlos Brenes and his wife, the other beneficiaries of these urgent measures are retired brigadier general \u00c1lvaro Antonio Baltodano Cantarero, 73; his son, \u00c1lvaro Baltodano Monroy, 47; and Larry Javier Mart\u00ednez Romero, 31. <\/p>\n\n<p>The ruling is part of the case <em>Juan Sebasti\u00e1n Chamorro et al. v. Nicaragua,<\/em> a file that has been open since 2021.<br\/><\/p>\n\n<p>The court found that the five Nicaraguans were detained and prosecuted \u201cwithout due judicial guarantees,\u201d in some cases under criminal charges that appear to have been used as retaliation for their \u201creal or perceived participation in activities related to opposition to the Government of Nicaragua.\u201d<br\/> <\/p>\n\n<p>In its resolution, the court urged the Nicaraguan state to: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Determine and disclose the whereabouts of the five beneficiaries.<\/li>\n\n\n\n<li>Proceed with their immediate release.<\/li>\n\n\n\n<li>Immediately adopt the necessary measures to \u201ceffectively protect the life, personal integrity, health, and liberty\u201d of the beneficiaries.<\/li>\n\n\n\n<li>Clearly inform family members and lawyers of their place of detention, facilitate immediate contact with relatives, and guarantee access to healthcare, medication, and adequate food. <\/li>\n\n\n\n<li>Ensure that trusted legal counsel has full access to case files and the online judicial information system.<\/li>\n\n\n\n<li>Refrain from \u201cprosecuting or retaliating\u201d against the beneficiaries\u2019 relatives and representatives.<\/li>\n\n\n\n<li>Report to the court no later than April 13, 2026, on the situation of the beneficiaries and the measures taken to comply with the ruling.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-precarias-condiciones-de-detencion-nbsp\">\u201cPrecarious\u201d Detention Conditions <\/h2>\n\n<p>The resolution describes the \u201cprecarious\u201d conditions in which the five detainees are being held.<\/p>\n\n<p>Carlos Brenes S\u00e1nchez\u2014who has played a \u201cleadership role among retired military personnel\u201d and within communities in Masaya and Carazo\u2014is reportedly being held in a cell under constant 24-hour camera surveillance.<br\/> <\/p>\n\n<p>According to the court, a light is kept on \u201cday and night,\u201d preventing him from resting, and he is allegedly subjected to psychological abuse, including verbal threats in which detainees are told they will die in prison and that their families have abandoned them.<br\/> <\/p>\n\n<p>His wife, Mart\u00ednez Aburto\u2014detained by police while \u201cwalking toward her home\u201d\u2014is also in a \u201csituation of particular vulnerability.\u201d <\/p>\n\n<p>\u00c1lvaro Baltodano Cantarero, detained on May 14, 2025, during a raid on his property without a warrant or formal charges, and his son Baltodano Monroy \u201care not receiving the medical care or medications they require.\u201d They are also being held in \u201cconditions of isolation, without adequate access to sunlight, medical care, or food compatible with their serious health conditions.\u201d <\/p>\n\n<p>On June 10, 2025, CONFIDENCIAL confirmed through sources linked to the judicial system that <a href=\"https:\/\/confidencial.digital\/en\/english\/retired-general-alvaro-baltodano-sentenced-to-20-years-in-prison-assets-confiscated\/\">Baltodano Cantarero had been sentenced to 20 years in prison for \u201ctreason.\u201d<\/a> On August 14, the Office of the Attorney General (PGJ) alleged \u201cmoney laundering\u201d to justify the imprisonment and asset seizure of Baltodano Cantarero and his son. <\/p>\n\n<p>Larry Javier Mart\u00ednez Romero was detained on August 13, 2025, in Masaya during an operation involving ten police officers who did not present a warrant. He was only told he would be taken in for a \u201cpolice interview.\u201d  <\/p>\n\n<p>Las autoridades penitenciarias de \u201cLa Modelo\u201d permitieron que se le entregaran insumos b\u00e1sicos de comida e higiene en septiembre de 2025, pero sin confirmar que se encontraba \u201crecluido en ese establecimiento\u201d. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-estado-sigue-en-desacato\">State Remains in \u201cContempt\u201d<\/h2>\n\n<p>Since the case was opened in 2021, more than 100 political prisoners have been granted provisional measures under the same proceedings, none of which have been complied with by the regime of Daniel Ortega and Rosario Murillo. <\/p>\n\n<p>In November 2022, the Inter-American Court of Human Rights declared the Nicaraguan state to be in \u201cpermanent contempt\u201d for repeatedly failing to comply with orders to release political prisoners, and referred the situation to the General Assembly of the Organization of American States, from which the dictatorship later withdrew. <\/p>\n\n<p>Nicaragua left the Organization of American States (OAS) in 2023, but the General Assembly has reiterated that this withdrawal \u201cdoes not affect the country\u2019s obligations\u201d under other human rights treaties, which \u201cremain binding on the State.\u201d
